Terms and conditions
- The customer, whose signature appears on this agreement, takes possession of the bicycle, e-bike and/or other equipment (hereinafter also “unit”) under the conditions listed below, which they accept and undertake to comply with.
- To rent one or more units, the customer must present a valid identity document. A customer may rent up to 4 units, which shall be under their sole responsibility towards the rental company and third parties. Any evidence exonerating the customer towards third parties does not exclude their joint and several liability for damage to property, to reputation and/or any further damage caused to the rental company. The bicycle must be returned at the agreed times and at the same place where it was rented, unless otherwise agreed in writing.
- Payment must be made in advance according to the rates in force at the time of rental. In certain cases a security deposit may be required, which will be refunded when the bicycle is returned undamaged and within the agreed time.
- The customer and the rental company will check together that the unit is in working order at the time of handover. By taking possession of the unit, the customer acknowledges that it is mechanically and electrically sound and fit for the purpose of the rental.
- Use of the unit requires the rider to be physically fit and technically competent. The customer therefore declares, without any reservation, that they have adequate ability and appropriate skills.
- The bicycle, the e-bike or any other unit must be used solely as a means of transport, with care and diligence. Racing, reckless manoeuvres, stunts and/or use on downhill routes, in bike parks or on trails are prohibited.
- The customer must comply with the Italian Highway Code (Codice della Strada) and assumes full liability for any damage caused to themselves, to third parties, to property and to the unit during use. This liability extends to every unit rented, without prejudice to exonerating evidence and to joint and several liability with the rider towards the rental company.
- maistra e-bike accepts no liability in the event of improper use of the vehicle, injury to persons or damage to property during the rental period and/or for conduct attributable to lack of skill on the part of the customer or of the riders of the various units rented by the customer on behalf of others.
- In the event of theft, the customer must immediately report it to the competent authorities, provide a copy of the report to the rental company and reimburse the full commercial value of the vehicle as indicated in the “RENTAL DETAILS” section.
- In the event of damage to the bicycle, the customer must pay the repair costs, which will be quantified by the rental company upon return or at a later date, following a technical assessment.
- Use of the bicycle is reserved for adults (18 and over). Minors may only use it if accompanied by an adult who assumes full responsibility by signing this agreement.
- The rental company may refuse to rent to any person deemed unfit to ride the bicycle under articles 186 and 187 of the Italian Highway Code (driving under the influence of alcohol or drugs) or for any other reason at the sole discretion of the rental company.
- Signing this agreement implies knowledge and unconditional acceptance of the rules, rates and opening hours of the rental service.
